India celebrates like no other country in the world. From grand weddings spanning multiple days to intimate birthday gatherings, from corporate milestones to festive Diwali nights — celebrations are woven into the very fabric of Indian life.

Yet for the millions of vendors who make these celebrations possible — the decorators, caterers, DJs, photographers, tent-wallahs, baraat operators — technology has largely left them behind. Their businesses run on word-of-mouth, WhatsApp groups, and paper ledgers.

CelebrationSky changes that. We are building a platform that combines the power of AI and modern technology with a deep understanding of Indian culture and the celebration business — making it effortless for vendors to manage bookings, attract clients, and grow their businesses.

CelebrationSky Technologies Pvt. Ltd. ("CelebrationSky", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform.

1. Information We Collect

a) Information you provide directly:

• Full name, business name, phone/WhatsApp number, email address
• City, years in business, business categories
• Instagram handle, website URL
• About your business, how you heard about us
• Messages sent through our contact form

b) Automatically collected data:

• IP address, browser type and version
• Pages visited, time spent, links clicked
• Device type, operating system
• Referring URLs and search terms

2. How We Use Your Information

• To process your vendor registration and onboard you to the platform
• To communicate with you about your registration, updates, and platform launch
• To send WhatsApp/SMS/email notifications (only with your consent)
• To personalise your experience on the platform
• To improve our services, platform features, and marketing
• To prevent fraud, abuse, and ensure platform security
• To comply with legal obligations under Indian law

3. Legal Basis for Processing (DPDP Act 2023)

Under India's Digital Personal Data Protection Act, 2023, we process your data on the following bases:

• Consent: You provide explicit consent when registering or submitting forms.
• Legitimate Interests: Operating and improving the platform.
• Legal Obligation: Complying with Indian law and regulatory requirements.

4. Data Sharing & Disclosure

We do not sell your personal information. We may share data with:

• Service Providers: Hosting (Hostinger), analytics, email/SMS providers who process data on our behalf under strict confidentiality agreements.
• Business Partners: Only with your explicit consent for co-marketing.
• Legal Authorities: When required by law, court order, or governmental authority.
• Business Transfers: In the event of merger, acquisition, or sale of assets, with prior notice to you.

5. WhatsApp & Marketing Communications

If you opt in to WhatsApp communications during registration, we will send you:

• Platform launch updates and onboarding information
• Booking notifications and vendor opportunities
• Promotional content relevant to your business category

6. Cookies & Tracking

We use essential cookies to ensure the platform functions correctly. We may use analytics cookies to understand how users interact with our platform. You can disable cookies in your browser settings, though this may affect some functionality.

7. Data Retention

We retain your personal data for as long as your account is active or as needed to provide services. Pre-launch registration data is retained for up to 3 years from the date of collection, or until you request deletion. Anonymised analytics data may be retained indefinitely.

8. Your Rights (DPDP Act 2023)

You have the right to:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate or incomplete data.
• Erasure: Request deletion of your personal data ("right to be forgotten").
• Withdrawal of Consent: Withdraw consent for marketing communications at any time.
• Grievance Redressal: Lodge a complaint with our Data Protection Officer.

9. Data Security

We implement industry-standard security measures including:

Despite our best efforts, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security.

10. Children's Privacy

CelebrationSky is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that a minor has provided us with personal data, we will delete such information immediately.

11. Cross-Border Data Transfers

Your data is primarily stored on servers in India. If we transfer data internationally, we ensure adequate protection through contractual safeguards compliant with Indian data protection law.

12. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of significant changes via WhatsApp or email. The "Last updated" date at the top of this policy reflects the most recent revision. Continued use of the Platform constitutes acceptance of the updated policy.

Please read these Terms of Service ("Terms") carefully before using the CelebrationSky platform operated by CelebrationSky Technologies Pvt. Ltd. ("we", "us", or "our"). By accessing or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering as a vendor, customer, or visitor on CelebrationSky ("the Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately stop using the Platform.

2. Pre-Launch Registration

CelebrationSky is currently in pre-launch phase. Registration as a Founding Vendor or interested customer is a non-binding expression of interest. No financial obligation is created by registering during the pre-launch period. We reserve the right to modify onboarding terms before the platform goes live.

3. Vendor Obligations

• Vendors must provide accurate, complete, and up-to-date information during registration.
• Vendors are solely responsible for the quality, legality, and fulfilment of services they list on the Platform.
• Vendors must not list services that are illegal, fraudulent, misleading, or violate third-party rights.
• Vendors must honour bookings confirmed through the Platform unless cancelled per the agreed cancellation policy.
• Vendors must maintain professional conduct with customers at all times.
• CelebrationSky reserves the right to suspend or terminate any vendor account found in violation of these terms.

4. Customer Obligations

• Customers must provide accurate contact and event details when making enquiries or bookings.
• Customers must honour confirmed bookings or cancel within the vendor's stated cancellation window.
• Customers must not misuse the platform to collect vendor contact information for direct solicitation outside the platform.
• Any disputes with vendors must first be raised through CelebrationSky's dispute resolution process.

5. Platform Use & Restrictions

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Transmit viruses, malware, or any harmful or disruptive code.
• Scrape, crawl, or data-mine the Platform without express written permission.
• Post false reviews, manipulate ratings, or engage in any form of fraud.
• Impersonate any person or entity or misrepresent your affiliation.

6. Intellectual Property

All content on the CelebrationSky Platform — including but not limited to text, graphics, logos, icons, images, and software — is the property of CelebrationSky Technologies Pvt. Ltd. and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

7. Payments & Commission

Specific payment terms, commission structures, and subscription fees for vendors will be communicated prior to the platform going live. CelebrationSky reserves the right to introduce a commission model, subscription model, or hybrid pricing at any time with reasonable advance notice to registered vendors. Use of the Platform after such notice constitutes acceptance of the updated pricing terms.

8. Cancellation & Refunds

Cancellation and refund policies for customer bookings will be governed by the individual vendor's policy as displayed on their profile. CelebrationSky acts as an intermediary and is not responsible for vendor-level cancellations. Platform subscription fees paid by vendors are non-refundable except as required by applicable law.

9. Dispute Resolution

In the event of a dispute between a customer and a vendor, both parties agree to first attempt resolution through CelebrationSky's mediation process. If mediation fails, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Bhopal, Madhya Pradesh, India.

10. Limitation of Liability

To the maximum extent permitted by law, CelebrationSky shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform. Our total liability in any matter arising out of or relating to these Terms shall not exceed ₹5,000 or the amount you paid us in the preceding three months, whichever is lower.

11. Indemnification

You agree to indemnify, defend, and hold harmless CelebrationSky Technologies Pvt. Ltd. and its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or third-party right.

12. Third-Party Links & Services

The Platform may contain links to third-party websites or integrate third-party services (including WhatsApp, payment gateways, and mapping services). CelebrationSky is not responsible for the content, privacy practices, or availability of these third-party services. Your use of third-party services is governed by their respective terms.

13. Modifications to Terms

CelebrationSky reserves the right to update these Terms at any time. We will notify registered users via email or WhatsApp before material changes take effect. Continued use of the Platform after notification constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Bhopal, Madhya Pradesh, India.
